Amendments Made to the Regulation on Private Teaching Institutions

AMENDMENTS MADE TO THE REGULATION ON PRIVATE TEACHING INSTITUTIONS

Introduction

With the “Regulation on the Amendment of the Regulation on Private Teaching Institutions of the Ministry of National Education” published in the Official Gazette dated 3 January 2025 and numbered 32771 (the Regulation), certain amendments have been made to the Regulation on Private Teaching Institutions of the Ministry of National Education. The main outlines of the amendments introduced within the scope of the Regulation are as follows:

  • Three new institutions to operate under the Ministry of National Education (MoNE) have been defined.
  • Regulations have been introduced regarding courses in international private teaching institutions.
  • The activities of certain institutions have been made subject to procedures and principles to be determined by MoNE.
  • Regulations have been introduced regarding the cancellation of institution opening permits and workplace opening and operating licenses.
  • New regulations have been introduced regarding institution opening permits and workplace opening and operating licenses of certain institutions.
  • Regulations have been introduced regarding physical conditions in special education and rehabilitation centers.
  • Regulations have been introduced for institutions that enter into brand license agreements.
  • Regulations regarding international diploma and certificate programs have been implemented.
  • New regulations have been introduced regarding fees of private teaching institutions.
  • Regulations have been introduced regarding procedures for students and trainees to be educated free of charge.
  • Amendments have been made to the regulation regarding dress code practices in schools.
  • Regulations have been introduced regarding the obligation to employ guidance counselors in private teaching courses.

New Institutions to Operate Under MoNE

Within the scope of the Regulation, three new institutions have been defined to operate under MoNE:

  • Student Activity Centers: Private teaching institutions to be established in order to provide education to primary school-age students in social, cultural, artistic, and sports fields in line with their interests, desires, and abilities, and to support them individually in completing their homework and projects.
  • Psychological Counseling Centers: Private teaching institutions where professional psychological support is provided individually and/or in groups to help individuals recognize themselves, develop decision-making and problem-solving skills, and improve their psychological well-being, as well as to offer training aimed at enhancing individuals’ professional knowledge and skills in the field of guidance and psychological counseling.
  • Language, Speech, and Occupational Therapy Centers: Private teaching institutions where individual and group education is provided in the fields of language, speech, and occupational therapy with the aim of developing individuals’ communication skills and speech fluency, enabling them to acquire age-, gender-, and culture-appropriate voice characteristics, increasing their adaptation to their environment, and ensuring their social participation.

Turkish Language Courses in International Private Teaching Institutions

In international private teaching institutions implementing programs other than the Turkish curriculum, Turkish language and Turkish history courses shall be taught as of 1 September 2025 in accordance with the weekly course schedules approved by MoNE.

Consultancy and Examination Services for Students

It has been regulated that real or legal persons wishing to provide consultancy and examination services to students within the framework of intercultural student exchange programs, or to students wishing to pursue their education abroad and/or those coming from abroad to study in Türkiye, shall conduct these activities in accordance with the procedures and principles determined by MoNE and published on the General Directorate’s website.

Institution Opening Permit and Workplace Opening and Operating License

An additional provision has been added to Article 6 of the Regulation on Private Teaching Institutions of MoNE titled “Procedures to Be Carried Out by the Ministry and Governorships,” stipulating that in cases where institutions are found to have been opened by submitting false information or documents, necessary measures shall be taken by the governorship, the institution opening permit and workplace opening and operating license shall be cancelled, and a criminal complaint shall be filed against the relevant parties.

In addition, it has been regulated that private children’s clubs operating under the Regulation on the Establishment and Operation Principles of Private Nurseries and Daycare Centers and Private Children’s Clubs may, within one year from the publication date of the Regulation, apply by meeting the standards determined by MoNE to become one of the private teaching institutions other than special education and rehabilitation centers, private motor vehicle driving courses, or private transportation services vocational training and development courses, in which case institution opening permits and workplace opening and operating licenses shall be granted.

The garden requirement sought for special education and rehabilitation centers has been abolished, paving the way for such centers to operate in detached buildings.

Brand License Regulation and International Diploma and Certificate Programs

Certain regulations have also been introduced regarding institutions that enter into brand license agreements. Accordingly, an additional provision has been added to Article 7 titled “Naming” of the Regulation on Private Teaching Institutions of MoNE, stipulating that for a founder to allow other real or legal persons to use the brand of a private teaching institution through a brand license agreement, the founder must have at least five institutions of the same type, each of which must have been operating for at least five years, and that founders may allow their brand to be used by other real or legal persons up to a maximum of three times the number of such qualifying institutions.

In addition, it has been regulated that schools’ international diploma and certificate programs shall be implemented in compliance with the general provisions of the Directive on the Implementation of International Diploma and Certificate Programs of the Ministry of National Education.

Fees in Private Teaching Institutions

The following regulations have been introduced to the section titled “Determination, Announcement, and Collection of Fees” regulated under Chapter Five of the Regulation on Private Teaching Institutions of MoNE:

  • When determining the fees for services other than meal, breakfast, and transportation fees for intermediate grades (such as boarding/dormitory, clothing, study sessions, international diploma and certificate programs, etc.), it has been regulated that the fee announced in the previous academic year shall be taken into account, and for continuing students, the fee specified in the student enrollment contract shall be considered, and that no increase exceeding [(the previous year’s average Domestic PPI + the previous year’s average CPI) / 2] may be applied. This regulation ensures that increases in such fees are limited to the inflation rate.
  • It has been regulated that schools may not charge any fee under the name of textbooks.
  • It has been stated that excessive increases may not be applied to the tuition fees determined for the entry levels of kindergarten, primary school, middle school, and high school.
  • It has been regulated that all fees determined by institutions must be published on the institution’s website.
  • In addition to the rule that tuition fees must be collected by depositing them into the bank account opened in the name of the institution and notified to MoNE/the governorship, the phrase “all fees to be collected in return for other services” has been added, thereby aiming for all fee collections of institutions to be carried out through the same method.

Students/Trainees to Be Educated Free of Charge

Another amendment made in the Regulation concerns students/trainees to be educated free of charge. It has been stated that the application conditions for private teaching institutions for children of martyrs and veterans and children under protection, who are given priority for free education, as well as procedures carried out by governorships and similar matters, shall be regulated in a guide prepared by MoNE. In addition, it has been regulated that, except for transportation fees, the specified individuals shall benefit free of charge from services such as meals, breakfast, boarding/dormitory, books and stationery, clothing, study sessions, and similar services.

Dress Code Practices in Schools and Guidance Counselor

With the amendment made in the Regulation, it has been stated that the provisions of the Regulation on the Dress Code of School Students Affiliated with MoNE shall now apply in private schools. It has also been stipulated that all schools, including those entering into brand license agreements, may not engage in practices that prevent parents from procuring clothing under free market conditions or that force parents to obtain clothing through electronic commerce platforms designated by the institutions. In addition, it has been prohibited to require parents to purchase special clothing that would impose a financial burden for use in in-class and extracurricular activities during special days, weeks, and celebrations.

Finally, with the new regulations introduced, it has become mandatory to appoint a guidance counselor or psychological counselor in private teaching courses.
